Terms & Conditions
1) DEFINITIONS
“Goods” means any goods and/or services provided by the Company as ordered by the Client
“Company” means Oakdale Campers Ltd
“Client” means the person, firm or company placing an order with the Company.
2) APPLICATION
These terms and conditions apply to any provision of services or materials by the Company to the Client.
3) FORMATION OF CONTRACT
All Goods sold by the Company are sold subject to the Company’s standard terms and conditions (as detailed below) which form part of the Client’s contract with the Company. Terms and conditions on the Client’s order form or other similar document shall not be binding on the Company.
4) QUOTATIONS
The prices, quantities and delivery time stated in any quotation are not binding on the Company. They are commercial estimates only which the Company will make reasonable efforts to achieve.
5) ORDERS
5.1 Orders will be deemed to have been placed when an email confirmation has been received from or on behalf of The Client and a non-refundable deposit has been received.
5.2 If you are purchasing a vehicle then your non-refundable deposit will secure your purchase.
6) RIGHT TO SUB CONTRACT
Unless otherwise agreed the Company shall be entitled to sub-contract all or any part of the work.
7) TIMETABLE
The Company will use its best endeavours to supply the services or materials within the quoted time but time will not be of the essence within the contract.
8) COPYRIGHT
The Client acknowledges that the rights to the Goods are owned by the Company and that the Goods are protected by United Kingdom copyright laws, international treaty provisions and all other applicable national laws.
9) RISK OF LOSS
The risk of loss or damage to the Goods shall pass to the Client upon delivery of the Goods.
10) PAYMENTS
10.1 A non-refundable deposit of £1000 is required to secure a build slot.
10.2 50 % of the balance is required 6 weeks prior to commencement of build for non-stock materials.
10.3 25 % of the balance is due 2 weeks prior to completion. The final 25% is due once the build is completed.
10.4 The Company reserves the right to increase a quoted fee in the event that the client requests a variation to the work agreed.
10.5 If you are purchasing a vehicle and have paid a non-refundable deposit you will be required to make the final balance before you take the vehicle away at a time and date agreed on.
10.6 All payments will be in UK Pounds Sterling made via BACS or bank transfer. Without prejudice to our other rights and remedies under the Conditions, if any sum payable is not paid on or before the due date, we shall be entitled forthwith to suspend the provision of Services to the Client.
10.7 We do charge a £100 per week storage fee for every week we hold the vehicle with no payment
11) CANCELLATION
In view of the nature of the service, any order – once confirmed by the Company – is not cancellable. Cancellation of the Order by the Client will only be accepted on condition that any costs, charges and expenses already incurred, including any charges that will be levied by a sub-contractor on account of their expenses, work or cancellation conditions will be reimbursed to the Company forthwith
Where the Client: fails to pay the charges listed in the contract or breaches the Contract in any other way we shall be entitled to (without prejudicing, losing or reducing any other right or remedy) suspend conversion process, or hold the camper until full payment is made. The completed vehicle will not leave the premises until customer account has been settled.
12) LOSS OR DAMAGE TO SUPPLIES
The Company will take all reasonable steps to ensure the protection from loss, damage or destruction of the services or materials it supplies to the Client (or which may be received from the Client).
13) WARRANTY
There is a 12 month warranty on conversion work and parts supplied by Oakdale Campers Ltd. Unreasonable usage causing damage or default is not included.
14) LIMITATION OF LIABILITY
The Client shall fully indemnify the Company against any liability to third parties arising out of the Client’s use of the Goods.
15) GOVERNING LAW
These Terms of Trading shall be subject to and construed in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
16) COMMENCEMENT & COMPLETION DATE
The contract for services shall commence on the Commencement Date listed. Oakdale Campers Ltd might suggest a completion date it is by no means a guarantee. We will endeavor to complete the vehicle by this date however there is often circumstances outside of our control. We will inform the customer of any delays and new completion dates. Oakdale Campers Ltd will in no way be responsible for any loss caused by the delay of conversion build, e.g. campsite fees or ferry crossings.
17) VEHCILE PURCHASE & ARRIVAL AT OUR WORKSHOP
If Oakdale Campers is purchasing a vehicle on the customer’s behalf, we will make all endeavors to help the customer purchase a safe and reliable vehicle. Oakdale Campers Ltd acts as a consultancy service in the vehicle buying process to help customers make an informed purchase. The customer shall have no right to bring any claim against us in respect to the vehicle itself. Any administration charge relating to the vehicle purchase will be paid by the customer. We do not accept any liability in respect to the use of vehicle by the customer or any future issues that may arise with the vehicle itself. If the customer is bringing an already purchased vehicle to us a full damage report is required on arrival.
Please ensure your vehicle is delivered to us with as little fuel in the tank as possible. This is especially important if you are having a heater installed. The vehicle must arrive clean and tidy. It is very important that no personal effects are left in the vehicle. Oakdale Campers holds no responsibility for any artefacts left in the vehicle.
18) SERVICES
We will provide the customer with the specification detailed on the final accepted quotation. Any changes made to the final accepted quotation during the build we will endeavor to complete, however no guarantees are made. Any additions will be added to the final bill payable on completion.
19) DESIGN OF THE PROJECT
The customer is required to sign off the project and colour choices. The customer will then receive a final quotation which is then confirmed as the final choice. This will be the final project design which the workshop will work off. Although we will offer advice and opinions the customer is responsible for the final design. Oakdale Campers Ltd will accept no responsibility for the appropriateness or accuracy of customer final choices.
Where applicable and requested by us, the customer shall timeously provide colour choices and other individualizations, any delay in the provision of this will result in a corresponding delay in the delivery of the conversion.
12) INDEMNITY
The Client hereby agrees to indemnify and keep indemnified Us, Our employees, officers, agents and contractors and hold Us, Our employees, officers, agents and contractors from and against any breach or non-observance by the Client of these Conditions and any claim brought against Us by a third party resulting from the provision of Services by Us to the Client, the Client’s use of the Services and the Server and the Client’s Materials placed on the Website including, without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses), howsoever suffered or incurred by us as a consequence of such breach or non-observance.
13) COMPLAINTS
Should you have any complaints about the services received from us, then you can contact us directly portal and submit a ticket detailing your issue. Please clearly state the product or service that you are experiencing an issue with and provide details of the nature of your complaint. A member of our team will aim to resolve your issue to the best of their abilities. All complaints will be acknowledged within 3 business days, and we aim to resolve any issues within 10 business days.
14) FORCE MAJEURE
We are not liable for any breach of the Contract or liable for any delay or failure in performance of any part of these conditions and its commitments when arising from or attributable to acts, events, omissions, accidents beyond the reasonable control of Us to perform and without limiting the generality thereof, shall include strikes; lock outs or other industrial action; civil commotion; riot; invasion; war; threat or preparation for war; fire; explosion; storm; flood; earthquake; subsidence; epidemic or other natural physical disaster, the possibility of the railways, shipping, aircraft, motor transport or other means of public or private transport, political interference with Our normal operations.
15) NOTICES
Any notices required to be given under the Contract by either party to the other shall be in writing, whether by letter sent recorded delivery, fax or email to the address of the other party as given in this Contract or the Action Plan or such other address as such party may from time to time have communicated to the other in writing. Any notice server by email shall, unless the contrary is proved, be deemed to be received on the day it was sent. Any fax shall be deemed to be served on receipt of an error free transmission report, or if sent by recorded delivery shall be deemed to be served two days following the date of posting.
16) ENTIRE AGREEMENT
The Contract represents the entire understanding between the customer and Oakdale Campers Ltd relating to the Services. The Contract supersedes all previous communications between the Client and Us (whether written or oral) relating to the Services. Nothing in the Contract removes or overrides any right of action by any party in respect of fraudulent misrepresentation, fraudulent concealment or other fraudulent actions.
Open Road Pods & Furniture Terms & Conditions
- Check the order before payment is made as any alteration to the order after payment will incur additional costs and cause delays.
- Upon collection or delivery(Not available on OpenRoad Pods) check all parts are present and correct as per your order before assembly.
- Due to the bespoke nature of our products if you order the incorrect colour or kit we will not accept returns. It is the responsibility of the purchaser to request samples if unsure about colour choice. Images on the website should be used as a guide only.
- Due to timber being a natural product variations in colour will occur on occasions which is a normal occurrence. Therefore we can not guarantee a perfect match in colours or grain on any of our natural timber products.
- We will not be held responsible for any losses incurred due to a delay in delivery, incorrectly cut or missing parts. We will solve any manufacturing errors quickly and send out replacement parts at no charge, but we will not be liable for delays or costs incurred, including paying extra labour costs as a result of this error.
- Cancelled orders that have been cut to your specification will incur a 20% handling charge + any handling / freight fees incurred.
- We will not be responsible for replacing units or repairing damage caused by Water Damage – Although The edges of the ply are sealed with lacquer to help prevent water ingress the ply can still wick water and bubble up when subjected to lots of water. Avoid getting the units wet when the tailgate or barn door is open and clear up any spilt water immediately.
- Unit builder preview images should be used only as a guide. It is the responsibility of the purchaser to ensure correct colours are chosen. No returns will be accepted for incorrect colour choice due to the bespoke nature of the units.
- Manufacturing time is 6 – 8 weeks after receipt of payment but this can alter due to workload. Please ring for current turnaround times. We will always let you know in advance your estimated time of completion for your furniture.
- All instructions provided and instructed by Oakdale Campers Ltd must be followed when using our OpenRoad Pods and other furniture. Failure to do so could lead to failure of the product which would not be covered by our 2 year guarantee.
- This is the default option on all Pods & Furniture. From payment allow ( current lead time ) weeks for manufacture and 3 days after processing for collection or delivery for UK mainland. At busy times this processing time will increase. Standard finishes normally take 2 to 3 days to arrive to us and non-standard finishes can take anywhere between 5 days to weeks dependent on product.
- Every effort will be made to process your order as quickly as possible however material supply and machine breakdowns can cause unexpected delays. Oakdale Campers Ltd will not be liable for any losses incurred due to a delay.
- Should there be any delay in manufacture due to machine down time or stock availability, we will contact you as soon as possible.
- Manufactured units to your specification can not be returned because of the bespoke nature of the product. Defects caused through actions of Oakdale Campers Ltd will however be rectified or replaced. The customer is responsible for returning the goods to Oakdale Campers Ltd for any works done under guarantee.
Delivery Arrangements (Not Available on OpenRoad Pods)
We will deliver to the delivery address specified for delivery. The location must be within mainland United Kingdom and within our pre-defined delivery areas (which exclude Northern Ireland, Channel Islands, Isle of Man, Isle of Wight, Scottish islands and other areas which we do not serve). The location must be accessible by road.
The delivery fee payable by you for your order will be that which is given by Oakdale Campers Ltd at the time you place your order. (Collection only for Openroad Pods & Bespoke Furniture)
Delivery will take place at the delivery address specified by you during the online order process. We ask you to provide us with a telephone number so we can contact you easily and advise you of your delivery.
You are solely responsible for ensuring that we are able to make delivery to the delivery address and that you are available to accept delivery at this address on the delivery date. Please try to inform us as soon as possible if you know that you are not going to be in to accept delivery. We shall not be liable in respect of any delay in delivery as a result of any act or omission by you.
If you are not personally available to accept delivery, you may appoint a representative to do so in your place. The representative must be an adult capable of receiving delivery on your behalf, and you agree that we will be entitled to rely on the representative’s instructions as if they were your own. Delivery staff are not permitted to leave any items that have not been signed for.
On delivery, you will be asked to examine the goods, check the condition of the packaging and whether the correct number of packages have been delivered. You will be asked to sign the delivery document confirming that the delivery has taken place, the number of items delivered, that delivery of the goods has not caused any damage to your property, that items are delivered “free of visible damage” and that you are happy with the service you have received. If there is obvious damage or items are missing or incorrect, you should record this on the delivery document. Missing items will be re-ordered and damaged/incorrect items will be returned and replaced and delivered free of charge. This will not affect your legal right to notify us at a later date if you subsequently find a defect in your goods. You must let us know about any damaged, missing and/or incorrect goods within a reasonable period of time after you have had an opportunity to inspect the goods. If you refuse to sign the delivery document, this will be taken as refusal to accept delivery.
Once the goods have been delivered to you (or your representative), you become the owner of those goods and from that point they will be at your risk. This means you will be liable for any subsequent damage, loss or destruction.
Damaged Items
If items within the packaging are faulty or damaged (whether before or during delivery), you shall notify Oakdale Campers Ltd customer services of such fault or damage using the telephone number stated on the sales receipt or in our delivery advice email / on our website as soon as possible after delivery quoting your order number. We require images to be emailed to help identify the parts that require replacing. Damaged or missing parts will be sent free of charge. Any part damaged by the customer can be replace at a cost to the customer.
Any damaged product/package must be retained for inspection at a later date. Should you dispose of any damaged product/package before we have had the opportunity to inspect it, then this could affect any claim for replacement.
Where it is established that we are responsible for damage to a delivered item, we will replace the damaged item or if we are unable to do so, we will reimburse you with the full amount you have paid for the product together with any delivery charges.
We will not accept responsibility for any items that are damaged during the delivery process to the extent that such damage is your fault.
If you are returning your goods because they are faulty or incorrect, no collection fee will be charged.
If you decide to return goods to us after you have started to assemble them then you should disassemble them to the extent necessary to allow them to be properly returned. However, if disassembly is reasonably likely to cause damage to an item please leave it assembled and let us know by contacting us
Our Liability
In the event of any unforeseen circumstances (including without limitation lorry breakdown, machine breakdown, technical issues, traffic accident, major traffic delays or severe weather) we will do our best to contact you to rearrange an alternative delivery time slot or date. We will not be responsible for any losses incurred due to a delay in delivery arising out of any cause beyond our control.
Further Terms
- All orders for parts or accessories must be paid for in full, prior to goods being Manufactured & dispatched
- Collection is possible if you follow the strict covid 19 guidelines put in place at our workshop.
- All “special orders” must be paid for in full prior to goods being ordered from our suppliers. “Special” means goods not normally stocked or supplied by
- All mail order goods are subject to our post and packaging charges.
- Delivery is only to UK mainland (Not Available on OpenRoad Pods)
- We reserve the right to cancel any order without explanation.
- We will not accept returns on any of our furniture due there bespoke made to order nature. We will however put any faults right that are deemed to be not caused by unreasonable usage causing damage or default.
- All goods remain the property of Oakdale Campers Ltd until paid for in full.
- All prices shown include VAT unless otherwise stated.
- Although we always attempt to meet quoted deadlines, we are unable to guarantee delivery/collection dates due to operational constraints.
- Every effort has been taken to ensure the accuracy of the contents of our website and brochure. However, the company cannot be held responsible for any errors that may occur.
- Due to a constant effort to improve our range of products and our prices, we reserve the right to alter specifications and prices without notice.
- Upon placing an order, you are agreeing to these terms and conditions.
- All Mail Order parcels must be checked for damages before signing for them. If Damage occurs please mark ‘DAMAGED’ on the carriers consignment note before accepting the goods.
- Failure to do this voids insurance claims against the carriers and we (Oakdale Campers Ltd) will not be held responsible for damage to goods whilst in transit.
- All damage, shortages or omissions must be reported to us within 3 working days.
- These terms and conditions and details in our brochure are subject to change without prior notice.
- These terms and conditions do not affect your statutory rights.
